Terms of Service

1. Definitions

• "DMCA AI" / "We": DMCA AI Co., Ltd., Tax ID: 0319113618
• "Customer" / "You": Individual or organization using DMCA AI services
• "Service": DMCA counter-notice service, including consulting, drafting counter-notices, and tracking results
• "Case": A specific DMCA counter-notice request for one or more URLs

2. Scope of Services

2.1. Services we provide

• Free DMCA case consultation and evaluation
• Drafting DMCA counter-notices in compliance with the DMCA Act
• Submitting counter-notices to Google on behalf of customers
• Tracking progress and notifying results
• 12-month warranty for successful cases

2.2. What is NOT included in our services

• Formal legal advice (we are not a law firm)
• Representation in lawsuits
• Handling cases of actual copyright infringement
• 100% success guarantee (results depend on Google and the claimant)

3. Terms of Service Use

To use our services, you commit to:

• Providing accurate and complete information about your case
• Having legitimate rights to the content affected by DMCA takedown
• Not using services for illegal purposes
• Cooperating during case processing

4. Pricing & Payment

4.1. Pricing

• DMCA Yearly Protection: $139 (website not yet reported)
• DMCA Homepage Recovery: $211 (homepage already reported)
• DMCA Inner Page Recovery: $5/URL (inner pages already reported)

4.2. "Pay After Success" Policy

For DMCA counter-notice services (does not apply to Yearly Protection):

• You only pay after Google restores search results
• If unsuccessful, you don't pay
• Payment within 3 business days after receiving success confirmation

4.3. Payment methods

• Bank transfer
• PayPal (for international customers)
• Cryptocurrency (upon request)

5. Warranty

5.1. Warranty scope (12 months)

• Applies to URLs successfully restored
• If the same URL is reported again for the same content/reason within 12 months, we re-appeal at no extra charge

5.2. Warranty does not apply when

• Content has significantly changed from the time of appeal
• URL or domain has changed
• New content violates Google's policies or laws
• Claimed by a different legitimate copyright owner

6. Refunds

6.1. DMCA counter-notice service

Per "Pay After Success" policy - no refunds as you only pay when successful.

6.2. Yearly Protection Plan

• Not activated: 100% refund within 7 days of payment
• Already activated: Pro-rated refund based on remaining time (minus 10% processing fee)

7. Limitation of Liability

• DMCA AI is not responsible for Google's final decisions
• No guarantee of exact processing time (typically ~24h but may take longer)
• Not responsible for indirect damages from website takedown
• Maximum liability equals the amount you paid for the service

8. Privacy & Data Protection

Data collection and processing follows our Privacy Policy.

9. Termination

• You may stop using services at any time
• We reserve the right to refuse or terminate service if you violate terms
• Warranty and liability limitation terms remain in effect after termination

10. Terms Changes

We may update these terms. Changes take effect immediately upon posting on the website. Continued use of services means you accept the new terms.

11. Governing Law

These terms are governed by Vietnamese law. Any disputes will be resolved at competent courts in Ho Chi Minh City.
