1. Scope of service

DMCA AI provides consultation, drafting, and filing support for DMCA counter-notices and related recovery work under the scope agreed for each case. We are not a government body, not Google, and do not replace courtroom counsel unless separately agreed. Learn the process in our DMCA appeal guide or form builder.

2. Client obligations

  • Provide truthful, complete information and only request help for content/URLs you are lawfully entitled to protect.
  • Do not ask us to support clear copyright infringement, fraud, or other illegal activity (see Content Policy).

DMCA AI is a drafting and filing support tool and service only. You remain fully and solely responsible before the law for the truthfulness and accuracy of every DMCA notice or counter-notice you provide or generate through our system. Knowing misrepresentation in DMCA filings can create liability under 17 U.S.C. §512(f) and related law — that liability rests with the declarant, not with DMCA AI.

3. Processing times

Our product targets index recovery in 24h via AI Agent after complete materials (USP; not a 100% every-URL guarantee). Google or platform review is typically 10–14 business days and is outside our absolute control.

4. Payment & warranty

5. Limitation of liability

To the extent permitted by law, DMCA AI is not liable for indirect damages arising from third-party decisions (Google, hosts, courts) after we have performed the agreed process correctly.

6. Acceptable use of tools

Free tools such as Check DMCA and counter-notice form builder are provided as-is for operational screening. Results are not legal opinions and must not be used to file false notices or counter-notices.

7. Intellectual property of this site

Site content (guides, case write-ups, branding) is owned by DMCA AI or its licensors. You may link to public pages with attribution; mass scraping for competing services without permission is not allowed.

8. Changes and governing notes

We may update these terms. Continued use of the site after publication of changes constitutes acceptance of the updated terms for website use. Case-specific agreements control over general website terms when they conflict.

9. Service boundaries in plain language

We help eligible site owners prepare and file counter-notices and related recovery paperwork. We do not promise Google will reinstate every URL, we do not litigate federal cases by default, and we do not file on behalf of parties who clearly lack rights in the content. If your situation is better served by a licensed attorney (active lawsuit, complex ownership chain), we will say so.

10. Acceptable use & anti-abuse

When using the website and free tools, you must not:

  • Send automated queries, run bots, or exceed the reasonable rate limits we apply to tools and forms.
  • Submit forms containing fake identities, spam, malicious code, or payloads intended to probe or attack the system.
  • Use our tools to produce false notices/counter-notices, harass third parties, or feed competing services without permission.

We may block IPs, discard requests, and refuse or suspend service immediately for abusive behaviour, and we retain technical logs as evidence for reports to competent authorities where needed.

11. Indemnification

You agree to indemnify DMCA AI for damages and reasonable costs (including attorneys' fees) arising from your provision of false information, misrepresentation of ownership, or breach of these terms that results in third-party claims against us.

12. Governing law & disputes

These terms are governed by the laws of Vietnam. Disputes are first resolved through negotiation and our complaint procedure within 30 days; failing that, disputes fall under the jurisdiction of the competent courts of Ho Chi Minh City, unless mandatory law provides otherwise. 13. Disclaimer

  • DMCA AI is not a law firm; site content and tool output are informational only and not legal advice.
  • The service is provided "as is" within the scope committed in each case agreement; we do not guarantee outcomes decided by third parties (Google, hosts, courts).
  • Published figures (98.45% success rate excluding .ru domains, 24h target) are operational metrics with stated conditions — not a promise for any specific URL.
  • In all cases, DMCA AI's total liability for a case is capped at the fees actually received for that case, unless mandatory law provides otherwise.
